The decision by the Ukrainian parliament to liquidate the Kyiv District Administrative Court (KDAC) does not comply with the constitution and the requirements of wartime.
This is stated in the statement of the KDAC released by its press service on the evening of 13 December.
"Today, the Verkhovna Rada adopted bill No 5369 on the liquidation of the Kyiv District Administrative Court and the establishment of the Kyiv City District Administrative Court. This decision does not comply with the provisions of the Constitution of Ukraine, the provisions of procedural legislation and the requirements of wartime," it argued.
The KDAC says that "tens of thousands of cases that are currently in court proceedings will be transferred first to the Kyiv District Administrative Court and then to the Kyiv City District Administrative Court. And each time the proceedings will be started from the beginning".
"Judges and court staff will act in accordance with the provisions of the constitution and relevant legislation," the statement reads.
Earlier on 14 December, the Ukrainian parliament adopted presidential bill No 5369 on the liquidation of the Kyiv District Administrative Court. Instead, the Kyiv City Administrative Court should be established.
