On Tuesday, 26 September, President Volodymyr Zelenskyy signed bill 9185 into law introducing a new type of punishment - probation supervision.

The law amends the Criminal Code, the Criminal Procedure Code and other legislative acts of Ukraine to improve the types of criminal punishment under martial law.

The explanatory note to the bill states that under martial law, there is a need to optimise pre-trial detention centres, in particular, to increase the number of places by liquidating short-term lock-ups, including those for holding prisoners of war.

Thus, a new punishment is introduced into the criminal punishment system in the form of probation supervision as the main type of punishment, which provides for a comprehensive impact on the offender without isolation from society for 1-5 years (1-2 years for minors).

It is proposed to supplement the sanctions of articles (parts of articles) of the Special Part of the Criminal Code of Ukraine with the punishment in the form of probation supervision as an alternative to restriction of liberty.
