The Law Enforcement Committee has recommended an alternative draft law that would deny parole to those convicted of murder, rape and road accidents with victims.

The Committee on Law Enforcement recommended that the Verkhovna Rada consider in the first reading draft law 11079-1, which provides for the release of certain categories of criminals for military service under contract. This is the revised version of the draft law. The first deputy chairman of the committee, Andriy Osadchuk, told LB.ua about the committee's decision in a commentary.

The recommended version of the draft law removes the right to be released for military service for rapists, murderers, and traffic violators whose actions have led to the death of people.

"The draft law is an alternative to the draft Law of Ukraine "On Amendments to the Criminal Code of Ukraine, the Criminal Procedure Code of Ukraine and other legislative acts of Ukraine on Early Release from Serving a Sentence for Military Service under Contract during a Special Period" (registration No. 11079 of 13.03.2024). The need to introduce this draft law is due to the inappropriateness of recruiting for military service persons who have committed criminal offences of intentional murder of two or more persons, or combined with rape or sexual violence, as well as criminal offences against sexual freedom and sexual inviolability of a person, crimes related to terrorist activities, and violation of traffic rules while intoxicated, which caused the death of several people," the explanatory note says. 

The draft law proposes amendments to the Criminal Code of Ukraine to regulate issues related to the early release of persons from serving their sentences for military service under contract for the purpose of their direct participation in the country's defence, protection of its independence and territorial integrity, as well as to establish liability for evasion of military service by such people. At the same time, parole from serving a sentence will not apply to persons convicted of crimes against the foundations of national security of Ukraine, convicted of the intentional murder of two or more persons, or combined with rape or sexual violence, as well as convicted of criminal offences under Articles 152-156-1, 258-258-6, part four of Article 286-1 of the Code.

It also proposes changes to entrust commanders of military units with the functions of administrative supervision over persons released on parole to perform military service under a contract, as well as to register such persons separately in a military unit.
