Malyuska: Businesses can apply for war damage compensation within months

But it is unlikely that compensation will be forthcoming unless Ukraine gains access to Russia's sovereign assets or wins the war fully on its own terms.

Not only private individuals, but also businesses will be able to receive compensation for the damage caused by Russia thanks to the register of losses. This was stated by Minister of Justice Denys Malyuska during the discussion "Crime and Justice: How to Bring the Aggressor to Justice" organised by LB.ua and EFI Group as part of the New Country project. 

According to him, certain categories of businesses that can apply will be announced in the coming months. Currently, much depends on the technical work.

"Because the amount of work to identify and open categories is huge. The forecast is available on the register and the official website. There is no statute of limitations for submitting evidence, you just need to have it," the minister said.

He added, however, that businesses should hardly expect to receive compensation for their losses unless Ukraine gains access to Russia's sovereign assets or wins the war fully on its own terms. 

For his part, Denys Maslov, Chairman of the Parliamentary Committee on Legal Policy, noted that there is currently no instrument to compensate businesses not because the government wants it to be so.

"There is a country's immunity. Even the aggressor country. It's nonsense, but there is an immunity of the aggressor country from decisions of national courts. We have a lot of decisions on recovery from the Russian Federation. I will not be mistaken if I even say that there is a consolidated criminal proceeding with a bunch of claims against the Russian Federation based on court decisions, and it is not being enforced because there is no property of the Russian Federation here. Everything that was here, the property, was sent under sanctions and so on," he explained.
