Due to the warfare on Ukrainian territory, some employees of the educational institutions had to leave the country. However, if the educational process is restored, the teachers have a right to work remotely, the educational ombudsman, Serhyi Horbachov, reported. 

The official reacted to the address from the educational workers who inquired about remote work. 

“Some of the managers, who are ignorant in the law, are illegally trying to deprive the Ukrainians the right to work, issuing orders banning remote work for those employees who are currently outside of Ukraine,” the educational ombudsman said. 

Serhiy Horbachov drew the attention of the heads and employees of the educational institutions that according to Article 60-2 of the Labor Code of Ukraine, remote work is a form of work, during which the work is performed by the employee outside the premises or territory of the owner or his authorized body, in any place of the employee's choice and with the use of information and communication technologies.

According to the fourth part of Article 60-2, in the case of remote work, the employees themselves determine the workplace. They are responsible for ensuring safe and harmless working conditions at their workplace. The current legislation does not impose any territorial restrictions on the employee's workplace in the conditions of remote work.

“So the educational workers can legitimately carry out educational activities using remote technologies while outside Ukraine," the official concluded.

The Education Ombudsman advised the heads of educational institutions not only not to violate the current labor legislation but also not to lose conscience in times of hardship when we all desperately need each other's support.

As early as Monday, March 14, educational institutions in many regions resume studies, including distance learning, under martial law after a two-week vacation.

As reported earlier, in 2022, there will be no external independent evaluation (ZNO), state exams, or entrance exams to the universities. The procedure for the university entrance will be changed.
