Parliament supports right to biological parenthood in case of military death

The bill was supported by 264 MPs. Previously, the law provided for the disposal of biomaterial in the case of the death of its owner.

Today, on 7 February, the Verkhovna Rada adopted the law on the right to biological paternity (motherhood) in the event of the death of a military officer, draft law 10448. This was reported by MP Iryna Herashchenko.

"The Verkhovna Rada has resolved the problem of biomaterial disposal in the event of the death of a serviceman by correcting the Radutskyy amendment. The biomaterial will be stored and the family of the serviceman will have the right to biological paternity in the event of the death of the hero," she wrote.

Herashchenko noted that the law introduces amendments that, among other things, stipulate that an individual whose reproductive cells are stored in accordance with the law has the right to dispose of them in the event of his or her death or declaration by a court of death or missing.

For his part, MP Yaroslav Zheleznyak said that the draft law proposes to provide for:

1. In the event of the death or declaration of death in accordance with the established procedure of a person whose reproductive cells are stored, their free storage in accordance with this Law is carried out within 3 years from the date of death of this person, and after this period, further storage of such cells may be extended at the expense of another person specified in the person's disposal of their own reproductive cells.

2. A person whose reproductive cells are stored in accordance with the law has the right to dispose of them in the event of his/her death. 

3. In the case of using reproductive cells of a person who has made an appropriate disposition in case of his/her death for conception of a child, this individual is recognised as the father or mother of the child born in such a way;

4. Establish that the will of a person, made and certified by a notary, prior to the entry into force of this Law in relation to their own reproductive cells, is the basis for the use of assisted reproductive technologies using these reproductive cells.
