Ukrainian Labor laws do not allow an employer to send employees on unpaid leave on the employer’s initiative. The Ministry of Economics reminded of the same in its press release today.
The Ministry explains: in situations when the operation of a company, separate departments of a company or individual employees is impossible because of war conditions, the employer has to announce downtime.
During downtime, the employees, at their will, could be transferred to a different assignment within the same company, institution, organization for the period of downtime, or to a different company, institution, organization located in the same locality for the period of one month maximum.
In cases when the downtime is announced, salaries are paid out depending on the conditions stipulated in a contract or an organizational and administrative act of the employer , but it cannot be less than two thirds of a regular salary.
