Today, on 9 May, the Verkhovna Rada adopted draft law 10379 on strengthening responsibility for military offences, including increasing fines for evading mobilisation. 

MP Yaroslav Zheleznyak announced the adoption of the draft law as a whole. 

"The Parliament voted in favour of draft law No. 10379 on amendments to the Criminal Code and the Code of Administrative Offences for violating mobilisation. There were 256 votes in favour. Objectively speaking, all the changes the committee promised to make to mitigate the situation have been made. Many negative provisions have been removed," the MP wrote.

For her part, MP Iryna Herashchenko said that the draft law proposes

  • new articles on liability for violation of military registration
  • Increased terms of administrative liability and administrative detention
  • Introduction of criminal liability for refusal to undergo a medical examination during mobilisation.

It proposes to increase the amount of fines and the duration of administrative detention (up to 3 years), which exceed the standards of even criminal law.

"The minimum fine for violations under these articles will be UAH 8,500 (compared to UAH 510 previously), and the maximum fine will be UAH 204,000 (compared to UAH 8,500 previously).

Violators will be able to be detained for up to three days.

Sanctions for violations of military registration are now more severe than for some military offences, such as desertion.

Some articles, in particular those related to administrative penalties, were softened for the second reading. For example, fines for violating the rules of military registration now amount to 200-300 minimum wages, and for violating the legislation on defence and mobilisation - 300-500 minimum wages. 

The draft law may lead to the blocking of accounts and property if the amount of fines is too high for individuals.
